Rental Agreement Terms & Conditions

Please read these terms carefully before renting a vehicle from HEY PHU QUOC.

Rental Agreement Terms

By booking or using a rental vehicle through HEY PHU QUOC, you confirm that you have read, understood, and agreed to these Rental Agreement Terms & Conditions.

1. Rental Eligibility

Customers must:

  • Provide valid identification or passport information when requested.
  • Meet the applicable minimum age requirements.
  • Hold a valid driving licence appropriate for the rented vehicle.
  • Provide accurate booking and contact information.
  • Accept responsibility for the vehicle during the rental period.

International visitors are responsible for ensuring that their driving licence and any required international driving permit are legally valid for driving in Vietnam.

2. Rental Period

The rental period begins at the agreed pickup time and ends when the vehicle is returned.

If you need to extend your rental, please contact HEY PHU QUOC before the original rental period expires.

Additional rental charges may apply for late returns or unauthorized extensions.

3. Vehicle Condition

Before accepting the vehicle, customers should inspect it and report any existing damage, scratches, defects, or missing equipment.

Once the vehicle has been accepted, the customer is responsible for taking reasonable care of it throughout the rental period.

4. Customer Responsibilities

Customers agree to:

  • Drive responsibly and follow Vietnamese traffic laws.
  • Wear a helmet when riding a motorbike.
  • Keep the vehicle secure when unattended.
  • Use the vehicle only for its intended purpose.
  • Not allow unauthorized persons to drive the vehicle.
  • Not use the vehicle for racing or dangerous driving.
  • Return the vehicle and all supplied equipment in reasonable condition.

5. Flat Tires & Punctures

🛵 Flat Tire / Puncture Policy

Flat tires and punctures can occasionally occur during a rental, particularly when riding on roads containing nails, sharp objects, potholes, or other hazards.

If you experience a flat tire:

  1. Stop riding as soon as it is safe to do so.
  2. Contact HEY PHU QUOC as soon as possible.
  3. Send us your current location and, if possible, a photo of the damaged tire.
  4. Do not continue riding on a completely flat tire, as this may cause additional damage to the wheel or vehicle.

Who pays for the repair?

Normal puncture:
If the tire is punctured during normal use and there is no evidence of misuse, the customer is generally responsible for the reasonable cost of repairing the puncture.

Tire damage caused by misuse:
If the tire, wheel, or other components are damaged because the vehicle was ridden irresponsibly, overloaded, driven through severe hazards, or continued to be driven while the tire was flat, the customer may be responsible for the resulting repair or replacement costs.

Tire failure caused by vehicle condition:
If the problem is determined to result from a pre-existing mechanical or maintenance issue, HEY PHU QUOC will handle the matter appropriately.

Important

Please contact HEY PHU QUOC before arranging major repairs or replacing a tire, unless immediate action is reasonably necessary for safety.

This allows us to help you find an appropriate repair solution and avoid unnecessary charges.

6. Damage, Loss & Theft

Customers may be responsible for costs resulting from damage, loss, or theft occurring during the rental period.

This may include:

  • Accident or collision damage
  • Damage caused by negligent driving
  • Water or flood damage
  • Loss of keys
  • Lost vehicle accessories
  • Damage caused by unauthorized use
  • Damage caused by continuing to operate a vehicle after a serious mechanical problem occurs

The actual amount payable depends on the nature and extent of the damage.

7. Traffic Fines & Violations

Customers are responsible for traffic fines, parking penalties, and other charges resulting from their use of the vehicle during the rental period.

HEY PHU QUOC is not responsible for penalties caused by the customer’s violation of Vietnamese traffic regulations.

8. Fuel

Unless otherwise stated in your booking, please return the vehicle with approximately the same fuel level as when it was collected.

Additional fuel charges may apply if the vehicle is returned with significantly less fuel.

9. Rental Price & Payment

The rental price is the price confirmed at the time of booking.

Additional charges may apply for:

  • Additional rental days
  • Late returns
  • Delivery outside the standard service area
  • Additional services
  • Damage or loss
  • Fuel replacement
  • Traffic fines

Any deposit or security requirement will be communicated before or at the time of rental.

10. Cancellation & Refunds

Cancellation and refund conditions may vary depending on the rental service and booking.

If you need to cancel or change your booking, please contact HEY PHU QUOC as soon as possible.

Any applicable refund will be processed according to the cancellation conditions associated with your booking.

11. Accidents & Breakdown

In case of an accident, breakdown, or serious mechanical problem:

Stop → Stay Safe → Contact HEY PHU QUOC

Customers should contact us as soon as reasonably possible.

Do not arrange major repairs without contacting HEY PHU QUOC first, unless immediate action is necessary for safety.

Customers must cooperate with relevant authorities when required.

12. Prohibited Use

Rental vehicles must not be:

  • Used for racing or speed competitions
  • Used for illegal activities
  • Driven under the influence of alcohol or drugs
  • Driven by unauthorized persons
  • Sub-rented or transferred to another person
  • Used to transport illegal goods
  • Used in a manner likely to cause unreasonable damage

13. Delivery & Return

Pickup and return locations must be agreed at the time of booking.

Customers should be available at the agreed pickup and return times.

Additional delivery or collection fees may apply outside the standard service area.

14. Personal Belongings

Customers are responsible for their personal belongings.

HEY PHU QUOC is not responsible for personal items left inside a rental vehicle.

15. Limitation of Liability

HEY PHU QUOC will make reasonable efforts to provide the rental service confirmed at the time of booking.

However, we cannot be held responsible for circumstances beyond our reasonable control, including severe weather, natural disasters, government restrictions, road closures, traffic conditions, or other unforeseen events.

16. Changes to These Terms

HEY PHU QUOC may update these Rental Agreement Terms & Conditions from time to time.

The latest version published on our website will apply to future bookings.

For HEY PHU QUOC, I would actually create separate rental terms for Motorbike Rental and Car Rental eventually.

The flat-tire clause above is particularly useful for the Motorbike Rental Terms, while the car agreement should have additional clauses for accidents, insurance, vehicle damage, fuel, parking, driving licence requirements, and chauffeur/self-drive responsibilities.

That will make your terms much clearer and more professional than having one huge generic agreement.
